Workers Compensation If you have been injured at your work or you have an injury or disease that is related to your work, you must report the injury to your employer immediately. Your employer by law cannot punish you or retaliate against you for filing a workers compensation claim. Your employer is supposed to provide you with a workers compensation claim form so that you can file your claim. All client's, also known as Applicant's within the Workers Compensation system, should expect that the workers compensation carrier, (insurance company) or permissibly self insured employers, will investigate how your work related injury occurred, the nature and extent of your injuries, and the extent of your permanent disability. You should expect that during the investigation, you will be followed and video taped by trained investigators. The film that the investigators obtain, (sub rosa - behind the bush) can and will be used by the insurance company to limit or prevent your being able to obtain a judgment or settlement. It is very important that you follow your doctor's advice, and not do anything that you have been ordered by a doctor not to do. It is very important that you attend all medical appointments, and follow written instructions that are sent from our firm from time to time. Sometimes, you will be required to attend hearings at the Workers Compensation Appeals Board depending upon the circumstances. You must attend all such hearings.
